Terms of Service

These terms are an agreement between you and Golf Anywhere LLC ("we", "us") for the Golf Anywhere apps for iPhone and Apple Watch, the game's online services, and golfanywhere.app (together, "Golf Anywhere"). By downloading or playing Golf Anywhere, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use Golf Anywhere.

1. Play safely

You swing a real phone or watch in this game. Before every session, put a wrist strap or lanyard on your phone and around your wrist, hold it firmly, and check that no people, pets or breakable things are within a full swing of you, including above you. Play only where you have room. Don't play near roads or water, on uneven ground, or anywhere you could fall. Stop if you feel pain, dizziness or tiredness.

You are responsible for your surroundings and your device. To the fullest extent the law allows, we are not responsible for injury, damage to your phone, watch or other property, or harm to other people that happens while you play. Golf Anywhere is a game. It is not a fitness, medical or golf-training device, and its distances and swing readings are for fun.

2. Who can play

You must be at least 13 years old, or older if your country requires it to agree to these terms on your own. If you are under the age of majority where you live, a parent or guardian must agree to these terms for you, and is responsible for your purchases.

3. Your account

• You sign in with Apple or Google. Keep that account secure, because anyone who can sign in to it can play as you and spend your coins.
• One person per account. Don't share, sell or transfer accounts, and don't use someone else's.
• Your display name must not be offensive, misleading, or impersonate anyone. We may change a name that breaks this rule.
• You can delete your account at any time in Settings. Deleting it permanently removes your progress, coins and items (see the Privacy Policy).

4. Your license to play

We give you a personal, non-exclusive, non-transferable, revocable license to download and play Golf Anywhere on Apple devices you own or control, for your own non-commercial use, as allowed by these terms and the App Store's Usage Rules. Golf Anywhere, including its courses, art, characters, music, story, software and the coins and items in it, belongs to us or our licensors. Everything not expressly licensed to you is reserved.

5. Coins, items and the shop

• Coins are virtual game currency. You earn them by playing, and you can also buy them. Items are virtual goods, such as outfits, clubs, shafts, balls, tracers and courses, that you earn or get with coins.
• Coins and items are part of your license to play (section 4). You don't own them, and they have no value outside the game. They can't be exchanged for money, sold, traded or transferred, except where the law says otherwise.
• Prices, rewards, daily shop stock, item availability and game rules can change. We may retire or change items, and fix balances that are wrong because of a bug or a reversed purchase. We'll do this fairly and avoid taking away anything you paid for without good reason.
• Our servers keep the official record of your coins, items and progress.

6. Purchases

• Real-money purchases (coin packs, the Starter Pack and Ad-free) are made through the App Store and are also subject to Apple's terms. Apple charges your payment method. Prices are shown in the app in your local currency.
• Coin purchases are consumed once delivered to your account. The Starter Pack can be bought once per account. Ad-free is a one-time, lifetime purchase that turns off ads between screens in the game.
• Refunds are handled by Apple, under Apple's policies, at reportaproblem.apple.com. If a purchase is refunded or reversed, we remove what it gave you. If you've already spent those coins, your coin balance may go below zero until it's made up.
• If something you bought doesn't arrive, use Settings > Restore purchases, or email contact@golfanywhere.app.
• Nothing in these terms limits any right to a refund or remedy you have under consumer protection law. In the EU and the UK, by completing an in-app purchase you ask for the digital content to be delivered immediately, and agree that you then lose your right to withdraw from the purchase.

7. Ads and rewards

Golf Anywhere may show ads, and may offer rewards (such as daily free coins) for watching a video. Rewards are given only after our server confirms them, and can be limited per day. Ads are provided by third parties, and we aren't responsible for their content or for the products they promote. Ad-free removes the ads shown between screens in the game.

8. Fair play

Don't:

• cheat, or use bots, scripts, modified apps, emulators or tools that fake swings, scores, rounds, purchases or rewards;
• exploit bugs to gain coins, items or progress (please report them to us instead);
• reverse engineer, decompile or tamper with the app or our servers, except where the law allows despite this restriction;
• attack, overload, probe or get around the security of our services, or access accounts or data that aren't yours;
• use Golf Anywhere to break the law or someone else's rights.

If you break these terms, we may remove progress, coins or items gained unfairly, or suspend or close your account. Where it makes sense, we'll tell you why and let you respond.

9. Updates and availability

We update Golf Anywhere to fix problems and add features. Some updates may be required to keep playing online. Golf Anywhere needs an internet connection to sign in and to save progress. Rounds you finish offline are saved when you're back online. We may change, pause or end features or the whole game. If we shut the game down, we'll try to give you reasonable notice in the app.

10. Ending these terms

You can stop playing and delete your account at any time. We may suspend or close your account if you seriously or repeatedly break these terms, if the law requires it, or if we stop offering Golf Anywhere. When your account is closed, your license and any coins and items end. Sections 1, 5, 11, 12, 13 and 14 continue to apply after these terms end.

11. Disclaimers

Golf Anywhere is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and we don't promise that the game will be uninterrupted, error-free or always available. Some countries don't allow these disclaimers. If you live in one of them, they apply only as far as the law allows.

12. Limits on our liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, coins, items or progress, arising from Golf Anywhere or these terms. Our total liability to you for any claim is limited to the greater of the amount you paid us in the 12 months before the claim, or US$50.

Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't allow to be limited. If you are a consumer in the EU or the UK, you keep all your statutory rights.

13. Your responsibility

To the extent the law allows, you will cover our losses and costs (including reasonable legal fees) from claims by others that arise from your breaking these terms or the law while using Golf Anywhere, or from injury or damage you cause while playing.

14. Governing law and disputes

These terms are governed by the laws of the United States and of the state in which Golf Anywhere LLC is organized, without regard to conflict-of-laws rules. Disputes will be handled by the state and federal courts located in that state. If you are a consumer, you also keep the protection of the mandatory laws of the country you live in, and you can bring a claim in your local courts. Please contact us first at contact@golfanywhere.app, because most problems can be solved quickly.

15. Additional terms for the Apple App Store

If you got Golf Anywhere from the Apple App Store, these terms also apply:

1. Agreement between you and us. These terms are between you and us, not Apple. We, not Apple, are solely responsible for Golf Anywhere and its content.
2. Scope of license. Your license is limited to using Golf Anywhere on Apple-branded products you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions. Other accounts in your Family Sharing group or volume purchasing can use it where those rules allow.
3. Maintenance and support. We are solely responsible for maintenance and support, as described in these terms or required by law. Apple has no obligation to provide any maintenance or support for Golf Anywhere.
4. Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If Golf Anywhere fails to meet an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the maximum extent the law allows, Apple has no other warranty obligation for Golf Anywhere, and any other claims, losses, liabilities, damages, costs or expenses from a failure to meet a warranty are our responsibility.
5. Product claims. We, not Apple, are responsible for handling any claims by you or a third party relating to Golf Anywhere or your possession or use of it, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws, including in connection with its use of the HealthKit and motion frameworks.
6. Intellectual property. If a third party claims that Golf Anywhere or your possession and use of it infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement and discharge of that claim.
7. Legal compliance. You confirm that you are not located in a country subject to a US Government embargo, or designated by the US Government as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
8. Developer contact. Questions, complaints or claims about Golf Anywhere go to: Golf Anywhere LLC, United States, contact@golfanywhere.app.
9. Third-party terms. You must comply with applicable third-party terms when using Golf Anywhere, for example the terms of your wireless data service.
10. Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right (and is deemed to have accepted the right) to enforce them against you as a third-party beneficiary.

If Golf Anywhere becomes available on Google Play, purchases there will be made through Google Play and also be subject to Google's terms, and refunds will follow Google Play's policies.

16. General

• Changes: we may update these terms. The effective date at the top shows when they last changed. If a change is significant, we'll tell you in the app before it takes effect. If you keep playing after that, you accept the new terms. If you don't agree, you can stop playing and delete your account.
• Whole agreement: these terms and the Privacy Policy are the whole agreement between you and us about Golf Anywhere.
• Severability: if part of these terms can't be enforced, the rest still applies.
• No waiver: if we don't enforce a term right away, we can still enforce it later.
• Assignment: you can't transfer these terms. We may transfer them, for example in a sale of the game, as long as your rights aren't reduced.
• Events outside our control: we aren't responsible for delays or failures caused by events we can't reasonably control.
